Ooops...


At the Project we are big fans of both Pussers and Goslings, and especially their trademarked signature drinks, the Painkiller and the Dark n Stormy. Both are small distillers who have invested tremendous time and personal treasure in developing and promoting their rums, and creating two extremely memorable drinks.

These signature drinks are part of their identity, and in accord with the law they are forced to defend themselves against unauthorized use of their name - failing to do so puts their hard earned names at risk if they fall into the public domain via their failure to act. That's a shame.

The last time this happened was at Inu a Kena, when Josh created a Dark n Stormy competition using a long list of rums other than Goslings Black Seal. Both I and a couple other posters pointed out the morality and legality and suggested he rename the contest to say "Dark Rum and Ginger". He laughed us off as being silly.

Less than a week later he received a cease and desist from Gosling's New York law firm, which he was forced to publish, along with an apology. He admitted the experience was so shocking he almost quit publishing. I'm glad he didn't.


And now Tiare...

Apparently Tiare has a budding love affair with Lost Spirits who has provided her with both their "Navy" rum and a new and as yet unreleased "Polynesian Style" rum. In return I'd guess, she altered Pusser's Painkiller by openly substituting LN's new rum, a clear violation of trademark/copyright. She made this substitution quite clear, stating "I was all of a sudden craving one of my favorite tiki drinks, the Painkiller but not with Pusser`s rum this time…..Now as much as I like both Josh and especially Tiare (with whom I've shared many emails) what's right is right, so I apologetically posted a very gentle reminder and plea to correct the name.

I respect Tiare and tend to believe she'll do the right, moral and legal thing by renaming her unauthorized "Painkiller". Will she? Check it out...

I've never understood why you like Tiare, however she seems to have removed your question. Let her shill away. It's no skin off your nose.

Well, for those of us in the Useless States, her site does have great info on various brands of Demerara rum that isn't easily available otherwise.
